SERVICE TERMS & CONDITIONS
- INTRODUCTION
Welcome to Prime Space Rentals. By using our website and services, you agree to comply with and be bound by the following Terms & Conditions. If you do not agree with these terms, please do not use our services.
- DEFINITIONS
- “Prime Space Rentals BnB” refers to the website and management company offering short-term rental services in Kenya.
- “Guest” refers to any individual or entity booking a rental property through our platform.
- “Host” refers to property owners or managers who list their properties on our platform.
- “Booking” refers to the confirmed reservation of a rental property.
- BOOKING & PAYMENT TERMS
- Guests must make full payment at the time of booking unless otherwise specified.
- Payments are non-refundable unless otherwise stated in the cancellation policy.
- Prime Space Rentals BnB reserves the right to cancel bookings due to non-payment or fraudulent transactions.
- Any additional fees (e.g., cleaning fees, security deposits) must be paid before check-in.
- CANCELLATION & REFUND POLICY
- Cancellation by Guest:
- Cancellations made 7 days before check-in will receive a 50% refund.
- Cancellations made less than 7 days before check-in are non-refundable.
- Cancellation by Primespace Rentals BnB:
- In the event of unforeseen circumstances (e.g., property damage, double booking), guests will receive a full refund or an alternative accommodation option.
- CHECK-IN & CHECK-OUT
- Standard check-in time: 2:00 PM
- Standard check-out time: 11:00 AM
- Late check-out requests must be approved in advance and may incur additional fees.
- GUEST RESPONSIBILITIES
- Guests must maintain the property in a clean and orderly manner.
- Any damages to the property must be reported immediately and may be charged to the guest.
- Noise levels must be kept to a minimum, and local laws regarding disturbances must be adhered to.
- Illegal activities on the premises are strictly prohibited and will result in immediate eviction without refund.
- HOST RESPONSIBILITIES
- Hosts must ensure that properties are well-maintained and meet safety and hygiene standards.
- Hosts must provide accurate descriptions and images of their properties.
- Hosts agree to honor all confirmed bookings unless prevented by Force Majeure (see Clause 10).
- LIABILITY & INDEMNITY
- Prime Space Rentals acts only as a facilitator and is not responsible for any damages, theft, or injuries occurring at rental properties.
- Guests agree to indemnify Prime Space Rentals and the property owners from any claims, liabilities, or losses incurred during their stay.
- DISPUTE RESOLUTION & ARBITRATION
- Any disputes shall first be resolved through good-faith negotiations.
- If unresolved within 21 days, the dispute shall be referred to mediation, with a mediator agreed upon by both parties.
- If mediation fails, disputes will be settled by binding arbitration in accordance with the Kenyan Arbitration Act (1995).
- The arbitration decision shall be final and binding.
- FORCE MAJEURE
Neither party shall be held liable for failure to perform obligations due to events beyond their reasonable control, including but not limited to natural disasters, pandemics, government actions, or labor strikes.
- GOVERNING LAW & JURISDICTION
This Agreement shall be governed by the laws of Kenya, and any disputes shall be resolved exclusively within Kenyan courts, unless settled via arbitration.
- MODIFICATIONS TO TERMS & CONDITIONS
Primespace Rentals BNB reserves the right to modify these Terms & Conditions at any time. Changes will be communicated to users via email or posted on our website.
